Welcome to Wayxon Marketplace (“Wayxon,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, mobile app, and related services (the “Platform”).

By creating an account or using Wayxon, you agree to comply with these Terms and applicable Nigerian laws, including the Nigeria Data Protection Regulation (NDPR) and the Federal Competition & Consumer Protection Act (FCCPA).


1. Eligibility

  • You must be at least 18 years old to use Wayxon.

  • By registering, you confirm that all information provided is accurate and complete.


2. Account Registration

  • Users must register an account to buy or sell on the Platform.

  • You are responsible for keeping your login details secure.

  • Any activity under your account will be considered your responsibility.


3. Use of the Platform

You agree to:

  • Use Wayxon only for lawful business and personal transactions.

  • Not post, sell, or promote prohibited, counterfeit, or restricted products.

  • Abide by Nigerian e-commerce and consumer protection laws.

Wayxon reserves the right to suspend or terminate accounts that breach these Terms.


4. Buyer Responsibilities

  • Review product details carefully before making purchases.

  • Ensure delivery details provided are correct and accessible.

  • Pay for products, shipping, and applicable taxes through approved channels.


5. Vendor Responsibilities

  • Vendors must provide accurate product descriptions, prices, and stock availability.

  • Vendors must issue receipts/invoices where required by law.

  • Vendors are responsible for shipping, packaging, and delivery timelines.

  • Vendors must comply with Nigerian tax laws, including VAT (if applicable).

  • Vendors must not list banned items (e.g., narcotics, firearms, counterfeit goods).


6. Fees & Payments

  • Wayxon charges vendors a [insert commission/flat fee] per transaction.

  • Payment processing is handled through secure third-party providers (e.g., Paystack, Flutterwave).

  • Wayxon may withhold funds in cases of disputes, fraud, or chargebacks.

  • Vendors are responsible for applicable taxes on their earnings.


7. Shipping & Delivery

  • Vendors are primarily responsible for shipping.

  • Wayxon may partner with logistics providers to facilitate deliveries.

  • Estimated delivery dates are not guaranteed.

  • Wayxon is not liable for delays beyond our control (e.g., logistics company failures).


8. Returns, Refunds & Disputes

  • Buyers have the right to request refunds for defective or misrepresented items in line with FCCPC consumer rights.

  • Vendors must clearly state their return/refund policy.

  • Wayxon may act as an intermediary in disputes but does not guarantee resolution.

  • Refunds, when approved, are processed within  60 business days.


9. Data Protection & Privacy

  • Wayxon processes personal data in compliance with the NDPR 2019.

  • We collect, store, and use your data only for legitimate business purposes.

  • Users may request access, correction, or deletion of their personal data by contacting us at contact@wayxon.com.


10. Prohibited Activities

Users may not:

  • Sell counterfeit, illegal, or dangerous products.

  • Use Wayxon for scams, pyramid schemes, or money laundering.

  • Manipulate transactions, ratings, or reviews.

Violation may result in suspension, termination, or reporting to relevant authorities.


11. Intellectual Property

  • All logos, trademarks, and content on Wayxon belong to us or our licensors.

  • Vendors retain rights to their product images and descriptions but grant Wayxon a license to display them.


12. Limitation of Liability

  • Wayxon provides the Platform on an “as is” basis.

  • We are not responsible for product quality, vendor behavior, or buyer actions.

  • To the extent permitted by Nigerian law, Wayxon is not liable for indirect or consequential damages.


13. Indemnification

You agree to indemnify and hold harmless Wayxon, its staff, and affiliates from any claims, losses, or damages arising from your use of the Platform or violation of these Terms.


14. Termination

  • Users may deactivate their accounts anytime.

  • Wayxon may suspend or terminate accounts for fraud, violations, or unlawful activity.


15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be handled by competent courts in Lagos State High Court.


16. Changes to Terms

We may revise these Terms occasionally. Updates will be posted with a new Effective Date, and continued use of Wayxon constitutes acceptance of the revised Terms.
